The African Legal Support Facility (the “ALSF”) has underscored its commitment to enhancing the legal and technical capacity of African governments to understand, structure, negotiate, and manage PPP agreements through two capacity building workshops which recently took place in Mbabane, Eswatini. The workshop, held from 28-31 October and 03-06 November 2025, was organised as part of ALSF’s efforts to lay the groundwork for the development of a legal framework governing PPPs in the country.
The capacity building workshop participants included senior representatives from a cross-section of bodies involved in the implementation of PPP projects, such as the Attorney General’s office, Ministries of Finance, Agriculture, Commerce, Health, Economic Planning and Development, as well as the Eswatini Water and Agricultural Development Enterprise, the Investment Promotion Agency and the Public Procurement Regulatory Authority. The participants, coming from diverse backgrounds – legal, technical, financial, and regulatory – are key to the successful development of PPP projects in Eswatini.
The workshop was a culmination of the advisory assistance that the ALSF has provided to the Kingdom of Eswatini. This assistance covered the review of the current legal, institutional and regulatory framework governing PPPs, highlighting key recommendations for a PPP law. Additionally, it involved the development of two toolkits containing relevant model documents aimed at supporting the implementation of PPP projects in the toll roads and the public buildings sectors.
The seven-day workshop focused on the identification and preparation of PPP projects, management of PPP contracts, an overview of the toolkits with model documents and agreements to assist contracting authorities, procurement processes, the use of PPPs to develop Special Economic Zones, and key considerations for a PPP law. A combination of real-time case studies and group exercises enriched the highly structured sessions delivered by facilitators from DLA Piper, the ALSF, Delta Consulting, and Robinson Betram.
Unlocking Private Capital for Economic Development
Governments in most African countries are increasingly focusing on unlocking private capital and leveraging PPPs to attract the much-needed financing from the private sector. The Kingdom of Eswatini recognises the importance of PPPs and is keen to establish the appropriate legal, institutional, and regulatory framework to promote the growth of PPP projects within the country. The Kingdom of Eswatini, with the support provided by the ALSF during the two workshops, has obtained the necessary recommendations and supporting documentation to facilitate the enactment of a PPP law, aiming to boost private investment through the PPP model.
