The African Legal Support Facility (“ALSF”) conducted a four-day capacity building workshop relating to public private partnerships (“PPP”) for Kenyan Government officials involved in the country’s PPP landscape.
The workshop, which took place in Nairobi from the 3-6 of December 2024, was within the framework of an advisory project that the ALSF is implementing in partnership with the Government of Kenya. Coming just two months after the inaugural Africa PPP Units Forum which took place in September 2024, the workshop discussed issues specific to the Kenya’s PPP Legal framework. Designed to be a pro solution oriented event, the Nairobi workshop targeted key sectors where PPPs could be used to promote sustainable development notably – water, health and the roads sectors.
The audience comprised of a wide array of national experts notably irrigation specialists, procurement officers, economists, finance analysts, engineers, accountants, project officers, commercial transaction experts and lawyers from the Ministry of Water, Sanitation and Irrigation, Ministry of Health, the Kenya Urban Roads Authority (KURA), Kenya National Highways Authority (KeNHA), and the PPP Directorate of the National Treasury and Planning.
The workshop was led by Mayer Brown LLP alongside Kaplan & Stratton and the ALSF. The agenda covered the structuring and implementing PPP projects in the water, health and the roads sectors while highlighting pertinent aspects related to risk allocation, pricing mechanisms and technical specifications.
The workshop follows a review and analysis of Kenya’s Government Support Measure (GSM) Policy and the creation of template PPP documentation in the water, health and toll roads sectors. Following an earlier workshop held in May in which the ALSF presented several recommendations on the GSM Policy, this workshop presented an opportunity for the PPP Directorate together with government officials in the water, health and roads sectors to review the template PPP documentation for use in upcoming projects.
For four days, Government officials brainstormed on the different documents as well as best practices and strategies for design and implementation of PPP projects in the road, water and health sectors.
The Government of the Republic of Kenya is making notable progress in its Public-Private Partnership (PPP) sector. This includes amending relevant laws, continuously updating its project pipeline, and now developing standardized PPP documentation aligned with international best practices, all aimed at attracting private sector investment.
About the ALSF
Established and hosted by the African Development Bank since 2008, the ALSF supports African governments by providing legal and technical assistance in negotiating complex commercial transactions. The ALSF also provides capacity building in key sectors, including energy, infrastructure and public-private partnerships, natural resources and extractive industries, and sovereign finance.
